The Sangh had filed a private criminal complaint in Wadgaon Maval court last year alleging that the group changed plans of building a residential project to a power project by fraudulently getting environment clearance. The Pune court had ordered a stay in April this year, following which Hiranandanis had approached the Bombay High Court. In June, the High Court had given relief to the Hiranandanis by vacating the stay, stating that a judicial magistrate first class (JMFC) could not impose stop work condition.
The Sangh had then filed a writ petition in the Bombay High Court and had also appealed in the Supreme Court to order a stay on the project. While Supreme Court granted stay earlier in August , in its recent order on August 26, the Supreme Court said, “The Bombay HC order on June 9, 2011 (to vacate stay) may be set aside and the High Court may be directed to hear the writ petition finally, expeditiously. We would request the HC court to dispose of the writ petition expeditiously, preferably within four months from the date of receipt/ production of a copy of this order.”
According to Dattatraya Padwal of the Navlakh Umre Vikas Sangh, the Hiranandani group had bought the land from about 50 to 60 farmers in Navlakh Umbre for a residential project but they later planned to use the land for a 2,500-watt power project of Hindustan Electricity Generation Company Private Limited promoted by Hiranandani Group.
